Mediation (from Latin, meaning “intervention”) is an extrajudicial, structured, and voluntary process for the constructive resolution of a conflict, in which independent, “all-party” third parties accompany the conflicting parties in their resolution process. The conflicting parties, also called mediands, attempt to reach a joint agreement that meets their common needs and overarching interests. This creates an energetic bond to keep the mediands at the negotiation table. The goal is to develop the outcome as a WIN-WIN consensus. The all-party third party (a mediator or a mediation team in co-mediation) does not make any decisions regarding the conflict but is solely responsible for the process. The path to a consensus outcome involves opening or maintaining the willingness for dialogue and conflict resolution.
